Terms of Service

Welcome to Optimic.ai. These Terms of Service ("Terms") govern your access to and use of the Optimic.ai platform, website, and services (collectively, the "Service") operated by Optimic AI S.L. ("Company", "we", "us", or "our"), a company registered in Spain.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

To use Optimic, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using our services under applicable laws
• Be authorized to act on behalf of your organization if using our business services

By using our services, you represent and warrant that you meet all of these eligibility requirements. If you do not meet these requirements, you must not access or use our platform.

3. Account Registration

To access certain features of our platform, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access or use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading.

4. Services

Optimic provides an AI-powered platform for growth automation and content intelligence. Our services include:

• GEO Scoring and AI Citation Tracking
• Answer Engine Optimization (AEO)
• Content analysis and optimization recommendations
• SERP monitoring and competitive analysis
• Revenue attribution and analytics
• Multi-language content intelligence
• API access and integrations

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice where practicable.

5. Fees and Payments

Our Service offers various subscription plans. All prices are displayed in Euros (EUR) and include applicable taxes (IVA) for customers in Spain and the EU, unless otherwise stated.

You agree to pay all applicable fees for your subscription plan and any additional services. By subscribing, you authorize us to charge the applicable fees to your payment method on a recurring basis until you cancel.

Subscriptions automatically renew unless cancelled before the renewal date.

6. Right of Withdrawal (EU/EEA/UK Consumers)

In accordance with EU consumer protection laws (including the Consumer Rights Directive 2011/83/EU) and UK Consumer Contracts Regulations, if you are a consumer in the European Union, European Economic Area, or United Kingdom, you have the right to withdraw from your purchase within 14 days of the transaction date without giving any reason.

However, you acknowledge that by expressly requesting that the Service begins immediately after purchase and using the Service, you may lose this right of withdrawal once the digital service has been fully performed.

To exercise the right of withdrawal:

• Send a clear statement by email to legal@optimic.ai
• You may use the model withdrawal form, but it is not obligatory
• We will process your refund within 14 days of receiving your withdrawal notice

EU consumers retain their statutory rights regardless of these Terms.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the platform for any illegal purpose or in violation of any laws
• Scraping, data mining, or automated extraction of platform data
• Attempting to gain unauthorized access to our systems or networks
• Interfering with or disrupting the integrity or performance of the platform
• Creating multiple accounts or using the platform through automated means
• Impersonating any person or entity or misrepresenting your affiliation
• Transmitting viruses, malware, or other harmful code
• Reselling or redistributing platform data without authorization
• Generating or distributing harmful, offensive, or illegal content
• Engaging in any activity that could harm minors

8. Intellectual Property

8.1 Our Content

The Optimic platform and all content, features, and functionality are owned by Optimic AI S.L. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store such content solely for the purpose of providing the Service.

You may not copy, modify, distribute, sell, or lease any part of our services or included software without our prior written permission.

9. AI-Generated Content

Content generated by our AI tools based on your inputs is provided for your use. You are responsible for:

• Reviewing all AI-generated content before publication or distribution
• Ensuring such content complies with applicable laws and regulations
• Verifying the accuracy and appropriateness of the content
• Any consequences arising from the use of AI-generated content

We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Optimic AI S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

For EU consumers, these limitations do not affect your statutory rights under applicable consumer protection laws.

11. Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform will immediately cease.

You may terminate your account at any time through your account settings or by contacting our support team at support@optimic.ai.

Upon termination, provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, where our company is registered, without regard to its conflict of law provisions.

For EU/EEA Consumers:

If you are a consumer in the European Union or European Economic Area, you benefit from mandatory provisions of consumer protection laws in your country of residence. You may bring legal proceedings in the courts of your country. You may also use the European Commission's Online Dispute Resolution platform:

For UK Users:

If you are a UK resident, you benefit from UK consumer protection laws. Nothing in these Terms affects your statutory rights under UK law.

For US Users:

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA). See our Privacy Policy for details.

For All Other Users:

Subject to applicable local consumer protection laws, any disputes shall be submitted to the courts of Spain. Where local law grants you additional rights, those rights apply.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Updating the "Last updated" date
• Sending an email notification for significant changes

Your continued use of the platform after such modifications constitutes your acceptance of the updated Terms.
